How Much Does A Process Server Charge?

All process servers will charge differently as they is no set rate for service of documents, if they are not funded by the LSC. If you have a LSC funded case then all Process Servers will charge £32 per hour and 45 pence per mile!

Estimated Charges

As i have stated above all companies will charge differently but the will range from £50 – £120 depending on the; Location, time scale, amount of attempts and millage. If you have a local process server and mainly instruct in the local area the charges will be around; £50 – £85 depending on the sort of process server you use.

They are many solo process servers who work for a couple of local clients who have either retired from the police force or an industry with the same sort of background; i.e. Bailiffs, environmental agency, etc. If you hire a process server of this background you may be able to get a local serve done for £50 as they don’t charge VAT and have no over heads.

If you hire a process server company prices are slightly higher due to over heads and so on, but they are more trusted, better suited and more beneficial.

The Basics Of A Process Server

A Process Server is somebody who aids in serving legal documents for the legal sector. People who work outside the legal sector, may not be aware of what a Process Server is. There are a lot of misconceptions about what a process server can do and what a process server actually does in relation to a normal deliver person or post man / women.

Why are they Need?

Why are they needed? Firstly, service of legal documents is a right set forth by the laws. This means that all citizens across the United Kingdom hold the rights to be informed of legal documents regarding them, these legal documents will hold information on the ‘set papers’ for example; Children’s Act, Non-Molestation Order, etc.

Process Servers are known as a form of delivery guy to notify individuals of their legal rights and to notify them off current court dates and what’s been summoned against them. For the manor of the documents there is an expected high quality of service to be made in place, within a professional and timely manner; for this reason, process servers were formed to help aid solicitors to produce the quality of services needed.

What do they actually do?

A Process Server is needed to undertake a variety of tasks such as; serving legal documents, preparing to sign, prepare proof of service (Affidavits, Certificate of Services and Statement of Service) and document retrieval. The main role and focus is to ‘serve legal documents on the said respondent, involved in a court case.’ After a Process Server have served the documents they have to provide evidence that the respondent has received and understood the legal documents that have been served. The verification that is needed are listed above as; ‘Affidavits, Certificate of Services and Statement of Service.’ The proof of service will need to be signed by the process server who has undertaken the service and on some cases a solicitor.

In some cases for whatever reason the debtor / respondent may not be have been served or the process-server can’t get hold of the respondent. In these circumstances they can send a letter of appointment to inform the respondent of the documents they have for service, once the letter is sent you have to allow two clear working days before they can visit again after the letter has been sent. When they return to the address the debtor can be served or in some cases the documents can be placed in a sealed envelope address to the debtor / respondent and placed through the letterbox. In some cases the documents cannot be placed through the letterbox but a Statement of Attempts can be prepared for the court.

Why would you need one?

They are necessary for many reasons, but the primary reason is to make sure that the due process is served professional and the debtor / respondent has received the documents and is aware of them. As if the documents are served on somebody else in some circumstances the Judge will not class this as service and if an order is made and broken this will be void do to how the process was undertaken, as the debtor / respondent may not off been aware. If the service is determined to be improper and unprofessional, the entire case may be thrown out and new documents may have to be re sealed, leaving the client more costs to deal with. This makes it even more essential to be aware of the laws and that you hire a professional well established process server.
